The FTC has taken action when that line gets crossed. In 2012, they fined Spokeo $800,000 for marketing data to job recruiters and background screeners without complying with the FCRA. The agency made it clear: if you act like a consumer reporting agency, you’ll be treated like one — disclaimers won’t save you. Since then, smaller enforcement actions have targeted similar violations when sites blurred the line between “people search” and “background check.”

Beyond fines, the FTC’s messaging keeps circling back to one principle: transparency. They want these companies to explain where data comes from and give users a clear way to opt out. That sounds reasonable, but in practice it’s messy. Some sites hide their opt-out links deep in the footer, others require ID verification, and a few quietly republish your info later under a slightly different domain. It’s like playing whack-a-mole with your own privacy.

There’s a human cost behind all this data, and that’s what often gets lost in the legal jargon. A wrong phone number might not seem like a big deal until it’s tied to debt collection calls that aren’t yours. A listed address might seem harmless until it leads a stranger to your door. The FTC has fielded complaints from people whose reputations or safety were harmed because outdated or false info stayed online for years. And once it’s out there, it spreads fast — copied by mirror sites and aggregators that seem to multiply overnight.

Some states are stepping in where federal rules lag. California’s Consumer Privacy Act gives residents the right to ask companies what personal info they hold, delete it, and stop them from selling it. Vermont and Colorado have similar data broker registration laws. The FTC supports these moves, calling them “complementary protections” that give consumers more leverage. But it also warns that fragmented laws make compliance complicated — both for users and companies trying to do the right thing.

Whenever I talk about this with friends, someone always says, “But all this stuff is public anyway.” That’s technically true. Property records, voter rolls, court filings — they’re all public documents. What the FTC points out, though, is that aggregation changes the privacy equation. Finding one record in a courthouse is different from having a stranger pull up your full life history on their phone in thirty seconds. What matters is control — knowing who’s profiting off your data, what they’re saying about you, and how to correct it when they’re wrong. That’s what the FTC keeps pushing for: a system where transparency isn’t optional.
